Explanation of Louisiana Workers Compensation Laws
Hi, I am attorney Greg Marceaux. If you have been injured on the job in Louisiana, you may have a workers’ compensation claim. Under Louisiana Workers’ Compensation law, you are entitled to medical care and income replacement benefits while you are injured and unable to work.
Medical care means that you have the right to choose your own doctor. The workers’ compensation insurer cannot force a company doctor on you. Medical care also entitles you to prescription benefits, physical therapy, surgery and any other medicals that your doctor believes that you need as a result of your injury.
Income replacement means that you should receive a check for sixty-six and two-thirds of your pre accident wages. These wage replacement benefits are not taxable.
Finally, under workers’ compensation you are entitled to recover medical mileage. Medical mileage covers you from your house to the doctor’s office, hospital or pharmacy. Your must keep track of your millage and submit to the workers compensation insurer for payment.
